§ 85-12. Town's authority within right-of-way.

  • Within the right-of-way, the Town of Oneonta is authorized to remove, or may direct to be removed, any and all obstacles, culverts, shrubs, decorative placements, ornaments, fences, trees, otherwise maintained, constructed or placed by property owners, when in the judgment of the Town of Oneonta, the tree, object, greenery, fence, etc. is:
    A. 
    A hazard to motorists;
    B. 
    An obstruction to sight distance;
    C. 
    An imminent threat to safe passage on the Town's road;
    D. 
    An impediment to maintenance, improvement or widening of a roadway;
    E. 
    Necessary to improve drainage and avert flooding of the Town's road.
